On July 11, the Supreme Court will hear petitions contesting the repeal of Article 370.

The petitions contesting the repeal of Article 370 of the constitution will be heard by the Supreme Court of India on July 11. The Supreme Court’s five-judge constitution bench, presided over by Chief Justice of India DY Chandrachud, will hear the matter, according to a notification from the top court.

Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant make up the constitution bench.

The Supreme Court will hear the group of over 20 petitions challenging the constitutionality of the Centre’s decision to repeal Article 370 of the Indian Constitution, which took away Jammu and Kashmir’s special status.

Additionally, the Centre made the decision to split the state into the UTs of Jammu and Kashmir and Ladakh. According to the petitions, the decision-making process broke down constitutional protections.

Shah Faesal withdrew from petition

Supreme Court will also take the decision on the withdrawal of the petition by IAS officer Shah Faesal. In September last year, Shah Faesal approached the apex court with a request seeking the withdrawal of his name from the list of petitioners who challenged the abrogation of Article 370.

The request to withdraw his name from the petition came as the government decided to accept his application to withdraw his resignation from the service and reinstated him as an IAS officer in April 2022.

The issue of Article 370 is sensitive for Jammu and Kashmir and recently PDP chief Mehbooba Mufti urged Supreme Court to hear the petitions challenging the abrogation of Article 370. “We want to invite the attention of the CJI to the petitions which are pending in the Supreme Court for the last four years and also towards the plight of … people, especially the youth who are in jails within and outside J-K without any trial,” she said.
